TERMS AND CONDITIONS OF THE SALE OF SERVICES VIA THE INTERNET
I. General provisions § 1

The Regulations define the general terms and conditions of using the Store as well as the rights and obligations of the Seller and the Buyer (hereinafter referred to as the “Service Provider” and “Customer”, respectively).
Through the Store, the Seller provides the Buyer with the possibility of concluding a contract for the sale of services available in the Store and other electronic products. The Seller provides services to the Buyer by electronic means.
By placing an order on the Website, the Buyer declares that he has read these Terms of Sale and accepts its provisions, and agrees to the processing of personal data in the manner and for the purposes set out in these Regulations.
II. Definitions § 2 For the purposes of these regulations, the following meanings are used:

Website – the website www.jamesbot.pl, containing a platform that allows searching and acquiring customers as part of the purchased Service, created by the Service Provider.

Client – a natural person with full legal capacity, a natural person running a business, a legal person, an organizational unit that is not a legal person, to which the law grants legal capacity, using the Service;
Consumer – a customer who is a natural person performing a legal transaction not directly related to its business or professional activity;
Entrepreneur with the rights of a consumer – a natural person concluding a contract directly related to its business activity, when the content of this contract indicates
that it does not have a professional nature for her, resulting in particular from the subject of her economic activity, made available on the basis of the provisions on the Central Register and Information on Economic Activity;
Customer Account – an individual, electronic account activated for the Customer in order to enable him to use the Service;
Agreement – Agreement for the provision of a Service;
Lead – contact details of potential customers found and acquired by Bot in the pre-sale process;
Service – a service provided by the Service Provider to the Customer consisting in searching and acquiring Leads, information about which is provided to the Customer in order to provide them with the Customer’s offer or to establish business cooperation;
Bot – a tool (software) created by the Service Provider dedicated to searching and acquiring Leads – based on the Customer’s contacts in given social networking sites – in order to provide the Service;
Subscription Period – a 1-month, 3-month, 6-month or 12-month period, starting from the date of receipt by the Service Provider of the confirmation of payment for the Service by the Customer;
Fee / Price – a cash payment specified by the Service Provider for the Service provided by the Service Provider to the Customer, the amount of which depends on the subscription period selected by the Customer;
Consumer Rights Act – the Consumer Rights Act of May 30, 2014 (i.e. Journal of Laws of 2020, item 287, as amended);
Regulation on the protection of personal data – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (general regulation on the protection of data) of 27 April 2016 (Journal of Laws UE L 119 of 04/05/2016);
Act on the provision of electronic services – the Act of 18 July 2002 on the declaration of electronic services (i.e. Journal of Laws of 2020, item 344);
Civil Code – the Civil Code Act of April 23, 1964 (i.e. Journal of Laws of 2020, item 1740, as amended).
III. Conditions for concluding the contract
§ 3
In order to gain access to the Service, the Customer registers the Customer Account on the Website at:
www.system.jamesbot.pl/user.
The contract between the parties is concluded at the end of the Account registration

The end of the registration of the Customer Account on the Website is confirmed by the Service Provider with a message
e-mail.
The customer is obliged to provide true and up-to-date during registration
data necessary to provide the Service by the Service Provider.

IV. Prices and Payment
§ 4
After creating the Customer’s account on the Website, the Customer selects and pays for access to the Service
in accordance with the prices applicable on the Website.
If a standing payment order is available and the Customer chooses this form of payment,
The Service Provider is authorized to debit the Customer’s account for orders
shipped on or after their payment, and the Customer undertakes to provide
sufficient funds in your account. In the absence of funds on the account

If, after the end of the Subscription Period, the Customer does not pay for access to the Service, access
to the Service is blocked and the Agreement for the provision of the Service is terminated.
The prices posted on the Website are given in Polish zlotys and are gross prices.

V. Copyright

The content posted on the Website, Bot and received as part of the provision of the Service by
The website is the property of the Service Provider and is protected. They are forbidden
commercial use, resale, duplication and sharing with others without
author’s consent.
VI. The right to withdraw from the contract

If, in the course of purchasing the Service, a Consumer or an Entrepreneur has the rights of a consumer
agreed to perform the contract and provide him with the Service before the deadline to
withdraw from the contract, he loses the right to withdraw from the contract concluded with

Withdrawal from the contract takes place by informing the Service Provider about its
decision by submitting a declaration sent by traditional mail or post

The Service Provider provides a template of the Withdrawal Form – constituting
Annex 1 to these Regulations. Failure to use the form in the process
withdrawal from the contract does not make the withdrawal ineffective.
To meet the deadline for withdrawing from the contract, it is enough to send a statement on
withdrawal to the correspondence address or e-mail address of the Service Provider before his
elapse.
In the event of withdrawal from the contract, the Service Provider returns the Consumer or
Entrepreneurs with the rights of a consumer all payments received from him.
The payment will be refunded using the same payment methods as
have been used by the Consumer or the Entrepreneur on consumer rights in
the original transaction, unless the Consumer or the Entrepreneur has consumer rights
clearly pointed to a different solution.
VII. Terms of Service
§ 7
The use of the Website by the Customer is possible under the condition of using
a computer with access to the Internet and the Chrome web browser – in
the latest version available on 10/12/2021.
The customer does not acquire any rights to the software on the Website.
VIII. Service Provider’s rights and obligations
§ 8
The Service Provider undertakes to provide the Customer with a Service consisting of
searching and acquiring customers, using the bot about which information
are provided to the Customer in order to make the Customer’s offer available to them or to establish a connection
economic cooperation.
§ 9
The Service Provider will enable the Customer to use technical support services for the Service.
Technical support consists in the provision of advice and explanations by the Service Provider
the scope of the Service’s operation.
Technical support is provided at the e-mail address

The Service Provider reserves the right to make temporary breaks in operation
System for maintenance, repair, and in particular for updating
and expansion of the System.
IX. Liability for defects
§ 10
The Service Provider’s obligation is to provide the Buyer with a product free from defects

In order to submit a complaint, the Buyer may use the complaint form
constituting Appendix 2 to these Regulations.
All complaints regarding the Service should be submitted by e-mail to
address office@jamesbot.pl or in writing to the address of the Service Provider.
It is recommended that the Customer provide the following information in the complaint description: legible
Customer designation allowing for identification in the system, description of the fault / error / defect,
along with an indication of the time of its occurrence, providing the version and name of the browser
website on which the indicated problem occurs.
Providing the above-mentioned information and circumstances will facilitate the process of processing
complaints. This information does not affect the effectiveness of complaints made with
omitting the recommended description of the complaint.
The Service Provider will notify the Customer in a message about the consideration of the complaint and its result
sent to the e-mail or correspondence address provided by the Customer in
complaints within 14 days.
Details of the Seller’s warranty for defects are governed by the provisions of the Code
civil.

X. Personal Data Protection
§ 11
The administrator of clients’ personal data within the meaning of the provisions of the Regulation
on the protection of personal data is the Service Provider, ie James Bot Sp. z o.o., ul.
Gwiaździsta 62/12/2, 53-413 Wrocław, KRS: 0000945186, NIP: 8992915059.
The Service Provider ensures protection of the processing entrusted to him by the Clients
personal data.
The processing of personal data takes place in accordance with the provisions in force
rights, in particular in accordance with: the Regulation on the protection of personal data;
Act on the provision of electronic services and relevant acts
implementing this act.
The processing of personal data of customers takes place in order to ensure correct
implementation of the Service, informing Clients about the Service Provider and provided by him
services and for other purposes, provided that the Customer expressly agrees to it separately.
As part of the Agreement, the Service Provider processes the following personal data of the Customers: first name,
name, address of residence / business, company name, postal address
electronic, contact telephone number, tax identification number.
Providing personal data by customers is voluntary, but it is
necessary for the performance of the Service.
Detailed information on the protection of personal data is regulated by the Policy
Privacy and cookies. The privacy and cookie policy is shared
also on the Website in the Privacy Policy tab.
XI. Final Provisions
§ 12
These Regulations may change. For contracts concluded before the amendment
Of the Regulations, the Regulations in force on the date of conclusion of the contract shall apply.
In matters not covered by these Regulations, the provisions shall apply
Polish law, including the Civil Code, the Act on consumer rights or others
acts applicable to the operation and functioning of the online store,
in force in the Republic of Poland.
